Terms of Use

Last updated October 8, 2026

1. What this software is.

NOX Gem Scout is a personal record-keeping tool for buyers of gemstones. It stores notes, photographs, audio recordings, prices and contact details that you enter yourself. It does not identify gemstones, verify their characteristics, appraise their value, or check the accuracy of anything you record.

2. Provided “as is”.

The software is provided as is and as available, without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, or uninterrupted operation.

3. Your decisions are your own.

Nothing in this software is advice — commercial, financial, gemmological or legal. Text recognition from business cards, currency conversion, price calculations and any other automated output may be wrong. You are responsible for verifying every figure and every detail before you rely on it. The developer is not liable for any purchase, sale, offer, valuation or other decision you make.

4. Limitation of liability.

To the fullest extent permitted by law, the developer is not liable for any loss or damage arising from use of or inability to use the software, including lost profit, lost opportunity, lost or corrupted data, business interruption, or any indirect or consequential loss. Where liability cannot lawfully be excluded, it is limited to the amount you paid for the software in the twelve months before the event.

5. Your data is on your device.

All records are stored in your browser’s local storage on the device you use. They are not transmitted to the developer and are not backed up anywhere. Clearing your browser data, uninstalling the app, resetting the device, or the device being lost or damaged will destroy those records permanently. Making and keeping backups with the app’s export function is your responsibility alone.

6. Data about other people.

Business cards, contact details and photographs you capture may contain personal data belonging to other people. You are responsible for collecting and using that data lawfully in your jurisdiction, including obtaining consent where required.

7. Licence.

You are granted a personal, non-exclusive, non-transferable licence to use the software. You may not resell it, sublicense it, share licence keys, or attempt to circumvent its licensing.

8. Payment and refunds.

Purchases are processed by a third-party merchant of record, whose own terms govern the transaction. Refunds follow that merchant’s policy. A monthly subscription may be cancelled at any time and continues until the end of the paid period.

9. Changes.

These terms and the software itself may change. Continuing to use the software after a change means you accept it.

10. Termination.

You may stop using the software at any time. The licence ends if these terms are breached.

11. Governing law.

These terms are governed by the laws of Thailand. Any dispute is subject to the exclusive jurisdiction of the courts of Thailand.
